American Property Management, Inc. (“APM”) respects your right to privacy and understands that strong privacy protections are key to your use of our services. This privacy policy (this “Privacy Policy”) is effective as of the first date written above and informs you of our policies and procedures regarding the collection, use, protection, disclosure, and management of your information that is provided to us by your use of www.americanpropertymgmt.com and the services provided thereunder (collectively, the “Services”). We may change or add to this Privacy Policy at any time without direct notice to you, so we encourage you to review our Privacy Policy periodically. Your use of the Services, and your continued use of the Services after any update or revision is posted on our website, constitutes your acceptance of all the terms and conditions of this Privacy Policy.

WHAT INFORMATION DO WE COLLECT?

VOLUNTARILY PROVIDED INFORMATION

When you or any authorized party use the Services, we receive and may keep your information voluntarily given to us that specifically identifies you or contains other personally identifying or sensitive information (collectively, your “Personal Information”).

This Personal Information may include:

  • Your financial information;

USE OF COOKIES AND OTHER TECHNOLOGY TO COLLECT INFORMATION

We want you to be aware that certain online tools exist to help us serve and recognize you when you use the Services. For your convenience, to help us personalize your experience and better serve your needs, we may receive and store certain types of information when you use the Services. ONCE INFORMATION IS RECEIVED, HOW IS IT USED AND / OR SHARED?

WITHIN APM

We use all information we collect, including Personal Information, for the exclusive purposes of providing you the Services, operating the Services, improving the Services, improving the Services’ features, marketing our Services to you, and enforcing our Terms and Conditions.

OUTSIDE of APM

We keep your Personal Information, specifically including all financial information provided to us, strictly confidential, take commercially reasonable precautions to protect your Personal Information against unauthorized use, access, and disclosure, and do not share, sell, rent, or lend your Personal Information to any unaffiliated third parties without your prior written consent. In addition, we may, without your prior written consent, share information with unaffiliated third parties, including Personal Information, when (1) required by law, (2) trying to protect against or prevent actual or potential harm to any person, fraud, or unauthorized transactions, (3) investigating fraud or criminal acts that have already taken place, or (4) as necessary with service providers as set forth below.

RETENTION OF PERSONAL INFORMATION

We retain your Personal Information for as long as necessary to fulfill the purpose(s) for which it was collected and to comply with applicable laws. Your consent to such purposes(s) remains valid after any termination of our relationship with you, this Privacy Policy, or our Terms of Service.

RIGHT TO TRANSFER

You hereby acknowledge and agree that we also have the right to disclose and/or transfer this agreement, all Personal Information, and all Non-Identifiable Analytic Information (as defined below) to a third party in the event of a proposed or actual purchase, sale (including, but not limited to, liquidation, realization, foreclosure or repossession), lease, merger, amalgamation or any other type of acquisition, disposal, transfer, or conveyance of all or any portion of APM or of any of its capital stock or business assets.

SERVICE PROVIDERS

We may employ third party companies and individuals to facilitate, analyze, and improve our Services including, but not limited to, maintenance services, database management, web analytics, etc. (collectively, “Third-Party Services”). The providers of Third-Party Services may have access to your Personal Information, but only for the purpose of providing Third-Party Services, and such Third-Party Service providers shall be obligated not to disclose or use your Personal Information for any other purpose.

AGGREGATE INFORMATION AND NON-PERSONAL INFORMATION

We may share aggregated information with third parties that we collect from users of our Services, and such aggregated information includes, but is not limited to (1) non-identifying information about you (e.g., how long you used the Services, geographic region, etc.), and (2) data that our servers automatically record when you use our Services (“Non-Identifiable Analytic Information”). We use such Non-Identifiable Analytic Information for Service analysis, industry analysis, and demographic profiling. Any aggregated information shared in these contexts will not contain your Personal Information.

PERSONAL INFORMATION MANAGEMENT

HOW TO STOP RECEIVING ELECTRONIC COMMUNICATIONS FROM US

When you fill out one of our forms or other requests for information, you may choose to receive electronic communications from us that inform you about new or improved Services. In addition, we may send you electronic communications to help us learn more about you and your experiences with our Services. If, after you have shared your email address (or other electronic communication address) with us, you decide that you do not want to receive electronic communications from us, you have several options:

  • You can stop future electronic communications by clicking on the link shown in every electronic communication sent by us and unsubscribe.
  • You can visit your “Account Settings” and select not to receive any further electronic messages.

MISCELLANEOUS

OUR POLICY ON GATHERING INFORMATION FROM AND COMMUNICATING WITH CHILDREN ONLINE

We recognize the unique privacy concerns regarding children and are committed to protecting children’s online privacy. Our Services are not geared towards children. Pursuant to the Children’s Online Privacy Protection Act guidelines, we do not intentionally or knowingly collect Personal Information online from children under the age of 13. If a parent or guardian is made aware that a child under the age of 13 has provided us with Personal Information, please contact us by e-mail at apminfo@acg.com, and we will take commercially reasonable measures to remove the information about the child from our records.

OUR COMMITMENT TO DATA SECURITY

We take commercially reasonable technical and procedural efforts to ensure that Personal Information collected from you is protected against loss and unauthorized access. This protection applies in relation to all Personal Information stored in both electronic and hard copy form. We use industry standard security techniques to help protect against the loss, misuse, or modification of information that you have provided. While we have implemented the above security measures, you should be aware that 100% security is not possible.

WHAT HAPPENS IF I LINK TO ANOTHER SITE FROM THE SERVICES?

Our Services may, from time to time, provide links to other websites or services. Other sites and services have their own terms of use and privacy and security policies. We not responsible for how such third parties collect, use, or disclose your Personal Information if you provide it to them. If you choose to visit one of these sites or use their services, you will want to review the policies that govern that particular site.

Your California Privacy Rights

California residents have the right to receive: (1) information identifying any third party company(ies) to whom we may have disclosed (within the previous calendar year) your Personal Information for that company’s direct marketing purposes; and (2) a description of the categories of Personal Information disclosed. If you are a California resident and wish to obtain such information, submit a written request to us with “Request for California Privacy Information” as the subject line and in the body of your message. Please be aware that not all information sharing is covered by requirements and only information on covered sharing will be included in our response. Please also note that under California law, businesses are only required to respond to a customer request once during any calendar year.
